On 29 November\u00a02017 the Court of Justice handed down its ruling in the proceedings VCAST\u00a0Limited v. R.T.I. s.p.a. (Case C-265\/16).On 7 September\u00a02017the EU Advocate General stated in its opinion that ‘cloud computing’\u00a0relates to the access, through a telecommunications network on demand, to\u00a0shared computer resources where, unlike the conventional ways of registration\u00a0and reproduction the end-user does not purchase or hire the material computing\u00a0devices, but it uses the computing service and infrastructure provided by a\u00a0third party.Therefore in his\u00a0opinion this matter could not be considered an exception for private copies of\u00a0works protected by copyright\u00a0 and therefore considered lawful.The Court of\u00a0Justice has shared these conclusions and has clarified that the video\u00a0registration in\u00a0cloud\u00a0 cannot be considered lawful if carried\u00a0out with the ‘active’ intervention of third parties.<\/p>\n
In confirming this, the Court\u00a0of Justice has pointed out that the regime of exceptions and limitations to\u00a0copyright provided under art. 5 of the Directive 2001\/29 (InfoSoc) must be\u00a0interpreted in a restrictive way and hence, the so-called exception of private\u00a0copying (art. 5(2)(b), of the Directive) ‘must not be interpreted in away\u00a0which imposes the copyright owner to tolerate, beyond such limitation expressly\u00a0provided for, infringements of its rights through the realization of private\u00a0copying’.<\/p>\n
