The Italian Supreme Court has definitively ruled in favour of Piaggio, declaring inadmissible the appeal by Peugeot Motocycles SAS and Peugeot Motocycles Italia against the January 16th, 2023 ruling of the l Court of Appeal of Milan which, in line with the Court of Milan (at first instance), had ascertained the infringement by the latter, with reference to the Peugeot Metropolis vehicle, of the Italian portion of a European patent of Piaggio & C. S.p.a.<\/p>\n
The patent owned by Piaggio & C. S.p.A, specifically refers to the control of the system that allows a three-wheel vehicle to tilt sideways like a traditional motorbike, or the anti-roll system used in the MP 3 vehicle.<\/p>\n
It is therefore definitively established that the Italian portion of the European patent of Piaggio & C. S.p.A. has been infringed, prohibiting Peugeot Motocycles Italia from importing, exporting, marketing and advertising (including through the Internet) the Peugeot Metropolis on Italian territory, and that Piaggio & C. S.p.A. is entitled to be compensated for the damage incurred.<\/p>\n
Following, a subsequent ruling (for which terms of appeal to the Supreme Court are still pending), the Court of Appeal of Milan quantified the extent of the damages that Peugeot Motocycles Italia must pay to Piaggio & C. S.p.a. as a result of the ascertained infringement, in over Euro 1 million.<\/p>\n
