Suitex, an Italian fashion and luxury community, has asked us to examine the dispute between Chanel and Kamad Reworked, concerning the relationship between upcycling practices and trademark law in the luxury sector, on which the Paris Court has established a significant demarcation criteria.
When discussing the decision, our Francesca La Rocca Sena highlighted how the phenomenon of upcycling is set to increasingly clash with the limits set for the protection of distinctive signs, as well as with the need to obtain authorisation from trademark owners. The ruling therefore helps to define, in an increasingly precise manner, the boundary between sustainable creativity and the unauthorised use of registered trademarks.
