During its session on Tuesday, July 18, 2023, the House of Representatives approved the amendments to the Code of Industrial Property already promoted by the Senate, in anticipation of the technical deadlines for implementation. In addition to the various measures on the acquisition procedures, maintenance of industrial property titles and the circulation of innovation in general, the following should be noted as particularly incisive:

– The introduction of a system of double patenting, meaning that the Italian patent retains its effects also if for the same invention has been granted, to the inventor or his successor, a European patent valid in Italy or a unitary patent, with the same filing date or priority.

– The repeal of the c. D. Professor’s Privilege, whereby the ownership of inventions achieved in public research (universities and public bodies) no longer pertains to the employee researcher, but rather to the University or Research Body having positive repercussions on the national innovation heritage and with the consequence of aligning the system with that of other European countries.

– The prohibition of registration of brands evoked, pirated or imitative of geographical indications and designations of origin.
